Terms of Service
These Terms govern your access to and use of lumiportrait.com (the "Service") operated by LumiPortrait ("we", "us"). By using the Service you agree to these Terms.
1. What the Service Does
You upload a photo; we forward it to an AI processing server which returns six stylized portraits; we stream them back to your browser. The Service is provided free of charge, "as is", with no uptime guarantee.
2. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and the age of legal majority in your jurisdiction, you may only use the Service with the consent of a parent or legal guardian.
3. Acceptable Use
You agree not to use the Service to:
- Upload images of a person without that person's clear consent.
- Upload images of children except by their parent or legal guardian.
- Generate content that is sexual, violent, hateful, harassing, defamatory, deceptive, or otherwise illegal.
- Impersonate another person or misrepresent the identity of any subject.
- Reverse engineer, abuse, overload, scrape, or attempt to disrupt the Service or the underlying processing servers.
- Circumvent any rate limits, security mechanisms, or admin-only areas.
We may suspend access for anyone violating these rules and may report illegal activity to the appropriate authorities.
4. Your Content and Ownership
You keep all rights to the photos you upload and to the portraits we return. By submitting a photo you grant us a temporary, non-exclusive license strictly limited to processing that photo through the AI pipeline and returning the portraits to you. That license expires the moment your portraits are returned. We do not retain a copy.
You are responsible for ensuring you have the rights necessary to upload any image you submit.
5. Generated Output
AI-generated portraits may contain visual artifacts, errors, or unintended likenesses. You are responsible for reviewing any portrait before publishing or sharing it. We make no warranty about likeness accuracy or fitness for any particular use.
6. Third-Party Services
The Service uses Google Analytics for usage metrics, Brevo for transactional email (contact form), and external CDNs for fonts and JavaScript libraries. Their terms and privacy policies apply to their respective components.
7. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including without limitation merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
8. Limitation of Liability
To the maximum extent permitted by law, in no event will LumiPortrait be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service. Our total liability to you for any claim arising out of or relating to the Service is limited to USD $50.
9. Indemnification
You agree to indemnify and hold harmless LumiPortrait from any claim or demand, including reasonable legal fees, made by any third party arising out of your use of the Service or your violation of these Terms.
10. Changes to the Service or These Terms
We may modify or discontinue the Service at any time without notice. We may also update these Terms; the "Last updated" date above reflects the latest revision. Continued use after a revision constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which LumiPortrait is established, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction.
